Abstract

PABON LARA, Andrés Felipe. Criminal justice and private property during the early state-building process in Colombia. Rev. hist. derecho [online]. 2023, n.65, pp.2-2. ISSN 1853-1784.

This article focuses on the analysis of the projected criminal justice system during the early state-building process in Colombia, focusing social control rules about behaviors that undermined private property. It studies not only the first norms that emerged before the first criminal code of 1837, but also some judicial proceedings that show the application of these norms. It is concluded after this analysis that the republican model presented strong continuities in relation to the type of social control typical of the colonial order, in the sense of recreating a social model based on the differentiation and hierarchization of certain social sectors and the use of the legitimacy arising from the law as a guarantor of the interests of other sectors.
