The company's responsibility is an essential element of the partnership contract. Supported by contractual terms, laws, and doctrine, this paper analyzes the way responsibility develops in a historical period, which has a special significance: the evolution from the legal culture of the so called ius mercatorum towards the codifying, liberal regime of Commercial Law. This study demonstrates the existence of agreements limiting the responsibility of the members in general partnerships according to contract freedom before the first Commercial Code. The arrival of the Public Limited Company does not imply a significant transformation in the partnership contract in Seville, but it is of limited importance.
