Abstract

The term consuetudines and the syntagma malae consuetudines hold a significant role in the so-called "Feudal Revolution" theory. Mutationists treat them as crucial terms that indicate the patrimonialization of the banal power which happened c.1000. Despite such view, for medieval law those terms have a technical meaning, linked to the concept of ratio and the utilitas publica. In this text, we aim to review the criticism made to the mutationist theory, in order to rethink the use of the aforementioned terms (customs and bad customs) under the light of its specific technical value of the juridical terminology.
