Abstract

MARTINEZ, Adriana N.  and  ROSENFELD, Adriana. Gender perspective in international juridical instruments for environmental protection. Aljaba [online]. 2005, vol.9, pp.139-160. ISSN 1669-5704.

To tackle the juridical aspect of the environmental issue is one of the greatest challenges registered by law, since it implies the understanding of the environment as a whole without any political frontier. This acknowledgement, that involves the recognition of new paradigms, can only be accomplished by incorporating to the law system as a supreme guardianship good, the quality of life for every human being. The concept of enviroment is closely related to sustainable development and quality of life, overlapping all of them around the human being, the central protagonist and responsible individually and socially of his own destiny and the planet´s future. It is necessary to incorporate the gender perspective in the sustainable development management, since quality of life improvement can only be achieved if the equality concept that it covers, also implies gender equality. The most relevant juridical instruments for international enviromental protection have been considered, in order to analyse the incorporation of gender perspective and to make proper conclusions on its current state.
