In this article, the contents and nuances of the right to housing in the operation of state agencies in the city of Buenos Aires within a context characterized by mechanisms of urban development that prioritize urban design over urban planning of the modern city are discussed. In so doing, the links that certain State agencies establish with the local inhabitants of impoverished housing in Buenos Aires are examined, attending to the role of the State as a producer of social problems and classifications. In particular, the relations between "new settlements" and State agencies are examined by analyzing two State programs regarding urban spaces that are being reclassified: the land recovery programs of the Costanera Sur Ecological Reserve and the Ciudad Universitaria Natural Park. As is seen, the constitutional acknowledgement of the right to housing is reinterpreted in each case, according to the ongoing urban projects in each area and pressure from of the different sectors involved.
