The purpose of this paper is to analyze the discourse and social factors that are built around who "must" or "may" take care of the infants when partners break up. Such cases--when we seek to establish who will have custody of the infants--are particularly important since they allow the visualization of how gender influences the social construction of care that mothers or fathers can provide for their infants. To this end, the perspectives of mothers and fathers who are fighting over the custody of their children, and the experiences they have had with public officials who mediate and decide on the dispute, are presented. This article attempts to show how the social construction of care consists of gender clichés about motherhood and fatherhood that are involved in the violation of the human rights of those involved, especially the infants, who are supposed to be the focus of interest and protection.
