This paper is framed in the proyect of investigation UBACyT P040 whose director is Alicia Stolkiner. Informed consent is an aspect of social research that has become in recent years a prerequisite for sustaining the viability of a study within acceptable ethical aspects. The aim of this paper is to analyze the specificity of informed consent in research with people who has undergone a trial of insanity and as a result of it has been declared incapable. The methodology for this work is a documental study and the analysis of legal instruments (domestic and international) that legislate ethical aspects that must be considered in clinical research in health, and those that legislate the rights of people with psychiatric problems in Buenos Aires City and the Province of Buenos Aires.
