Abstract

MAZIN, Óscar. Agricultural Areas as Borders of the Indian Monarchy in 1650. Prohistoria [online]. 2015, vol.24, pp.21-41. ISSN 1851-9504.

Based on a judicial process that developed over decades, in which was debated nothing less than the destination of the tithes from the haciendas belonging to religious orders, the article analyzes the relation of the court of Madrid with the Indias. The particularity of this case is that, by the very nature of the object in dispute, the problem acquired continental proportions, extending from a latitude to another in the American space. Thanks to the relevance of the dispute, it is possible to analyze comparatively the legal, jurisdictional and judicial aspects, such as the agreement between the cathedrals to litigate together in the Consejo de Indias. The dynamic and the perdurability of the cause make possible to study in depth the court mazes along which agents and instances of government and justice -both from Madrid and Indias- circulated
