Abstract

Since the emergence of agriculture, thousands of years ago, rural producers have generated the necessary food for all societies. This historical fact places the seeds as a central element in agrarian production relations. Its significance is established because, on the one hand, it is the first link in the food chain, and    on the other hand, the seeds establish different forms of identity construction of human social relations with nature. This importance of seeds is disputed because with neoliberalism begins to develop a phenomenon where much of everything that was essentially common and was outside the market, is "enclosure" under a new property regime. This situation is a central factor for the establishment of new forms of scientific inquiry governed by the logic of the market and consolidated by the figure of intellectual property, which transforms the seeds and their associated knowledge into plausible elements to be protected and appropriate constituting which Bartra (2008) called "the rent of life". With particular emphasis on the Argentine case, in this article we intend to investigate the conformation of seeds as legal assets susceptible to appropriation according to the intellectual property system.
