This paper is intended to investigate on the non-commodification potential which is present in the norms of the Buen Vivir (Good Way of Living) in relation to the nature. In the first place, the discussions around the non-commodification of the social during the 20th century with the emergence of the welfare state are recovered and the reflections in relation to the non-commodification of nature that appeared in the second half of the 20th century in a context of opposition to the neoliberal state. Then a series of postulates of the Constitution of Ecuador of 2008, of the Constitution of Bolivia of 2009 and of Laws 71 and 300, both of Bolivia, are analyzed, in relation to their non commodification potential. From the analysis of the regulations, it appears that in the regulations of Good Way of Living, there coexist conceptions of nature as a commodity -similar to the scheme of sustainable development- with postulates that present a tendency toward non-commodification. As a final reflection, it is considered that the tension between commodification and non-commodification that exists in the regulations could be approach through the implementation of creative institutional designs that guarantee the effectiveness of the normative provisions of the Good Way of Living.
