Abstract

BECERRA, María Florencia  and  ESTRUCH, Dolores. Alcaldes de minas, capitulares, cateadores y mineros: Una reflexión sobre las administración de la justicia en las causas mineras de la puna de Jujuy (siglo XVII). Rev. hist. derecho [online]. 2011, n.42, pp.1-21. ISSN 1853-1784.

In view of the jurisdictional disputes that, throughout the 17th century, the Chapter House of Jujuy kept with the Lieutenant and Grate Mayor in mines of the jujenian jurisdiction northern end (Puna of Jujuy, specifically the departments of Santa Catalina and Rinconada), we attempt to develop a dual objective. Firstly, we aim to analyze the established dynamics between the actor’s practices and the rules that organized the administration of justice in mining trials, in a space that, compared to other mining centers, appears, at first, as "marginal". Moreover, and considering both the flexible and scalable nature of the iurisdictio and the typical dynamics of a mining activity, we try to identify a series of "intermediate" actors that integrated the jurisdictional-administrative world of mining activity in the Puna of Jujuy, reflecting on the ductility of a system that always appeared allowing new terminals of power. It is worth mentioning that, in order to develop our objectives, we will resort to documentary sources from an interdisciplinary perspective where both historic-anthropology and archeology approaches converge.
