By the end of the XIX century, Argentina's criminal law was codified to bring more legal security to the country. At the same time, the origin of the suspect's preventive detention during proceeding was regulated showing the difficulty of finding the balance between the search for protection of the individual freedom and preservation of public safety. Despite how detrimental this temporary measure was, no policies were designed to restrict its use. For this reason, this paper work focus  on the analysis of the judicial administration of Buenos Aires province and legislature  debates with the purpose of identifying the reasons that explain the wide range of legitimacy  that this institute enjoyed in the political elites.
