Abstract

This paper concerns the issue of the judicial treatment of the so-called personae miserabiles, namely persons in misfortune (particularly the American Indians), according to the vision of the Spanish legal doctrine of 16th and 17th centuries. One main judicial consequence of the membership to that category was the relieving of the penalties in case of crimes made by such individuals, what gave occasion to different legal problems in practise .
