Resumen
KABAT, Marina. Nuevas perspectivas para el estudio de la historia de la legislación laboral y la negociación colectiva en la Argentina. Rev. hist. derecho [online]. 2014, n.48, pp.99-120. ISSN 1853-1784.
To a large extent, the history of Argentine labor relations is still a pending issue. In spite of the extensive literature on the early attempts at regulation, as for example the Labour Code of 1904, there are no historical inquiries into fundamental norms such as rule 11729, in force from 1933 to the enactment of the Labor Contract Law in 1974. There is also no long-term research of collective bargaining. In this article our reflection is based on previous empirical work we have done examining a new source - collective bargaining files available in the National General Archive. They are an invaluable historical source that includes, in addition to the agreements, workers and employers' documents and the minutes of the hearings. By means of a thorough review of the secondary sources we analyze the potential of these documents by resorting to interdisciplinary strategies that incorporate methodology traditionally used by sociologists to examine contemporary collective bargaining, as well as the approach used by jurists to analyze jurisprudence.
