The discussion about the sources of law and case law, in particular, have been a controversial aspect and a key factor in the understanding of the national legal system and culture.

This article focuses on the description of the evolution of case law in the sources of Cuban law since the 19th century, taking into account its historical manifestations and some normative, doctrinal and practical expressions up to the present, which confirm the need and relevance of its normative recognition as a formal source.

The methodology used is essentially descriptive, using the analysis-synthesis, and within the specific methods, the historical-legal, logical-legal and exegetical-legal methods. This review takes into account the stages in which discussion about case law is inserted with reference to a general historical and legal framework in Cuba.
