Abstract

This article aims to contextualize the manifestation of the constituent power in 2020 in two particular societies: Chile and Peru. Two well differentiated socio-legal phenomena developed in the context of a pandemic, but which reflect symptoms of the same malaise of our American democracies in the neoliberal capitalist ethos: the exclusion and pauperization of increasing amounts of humanity.
