The article deals with the issue of American independence, emphasizing the political-constitutional litigation that gave rise to the confrontation between the colonies and the mother country. The approach focuses on the question of traditional English monarchy and seeks to show how the emergence of a new form of State altered the political relations on which the British Empire had been based until the early XVIII century
